Qualified Contributory Retirement Plan ValuationsIt is now possible under ERISA to fund the purchase of small business stock with 401k assets. The small business must be a C-Corporation. Also, the C-Corporation may be a member of an LLC, with other conventional investors. A business valuation is required by ERISA to ensure adequate consideration on the acquisition. Most trustees also require an annual Fair Market Value business appraisal of the plan's shareholder interest to meet the requirements of ERISA regulations. This requires a LEVEL THREE appraisal.
