401(k) Investment

It is now possible under ERISA to fund the purchase of small business stock with 401k assets. The small business must be a C-Corporation. Also, the C-Corporation may be a member of an LLC, with other conventional investors. A business valuation is required by ERISA to ensure “adequate consideration” on the acquisition.

ESOP Program

Employee Stock Ownership Programs require an initial and annual appraisal.  These appraisals must be USPAP compliant.
